People who access the ARTIFICERS MINI website (referred to as “User”) agree with these Terms of Use, with no limitation or qualification, acknowledging that this contract will prevail in relation to any agreements between the User and the website, as well as with the ARTIFICERS MINI Privacy Policy. If the User does not agree with these Terms of Use or the Privacy Policy, one must not use the website.

The access and use of this website (https://artificersmini.com/), and all the others related and operated by ARTIFICERS MINI (Artificers, Miniaturas e RPG LTDA.), is subject to the following terms and conditions, as well as all applicable laws:

1. The User agrees that the website and its contents, such as HTML/CSS, Javascript, documents, videos, images, graphics, photos, texts, notes, voice recordings, sound, arts, files and other materials, which are provided by ARTIFICERS MINI or by third parties, are kept for their use and personal information by ARTIFICERS MINI, characterized as its property, including intellectual property, and/or its contracted suppliers. Therefore, the User agrees that all content on the website must follow the rules of these Terms of Use and that its use is limited, according to the contracted service. The User is prohibited from copying, reproducing, republishing, posting, transmitting, distributing, using for public or commercial purposes in any way, whether free or onerous, nor may one modify the content, under penalty of violating the copyright and property rights of ARTIFICERS MINI, as well as the authors who created the materials, and will be subject to monetary damages and other penalties provided in conventions, treaties and legislation to which Brazil and the User's country of nationality are signatories.

2. All content mentioned in the previous item and others on the website are protected by copyright, unless otherwise stated, and are the property of ARTIFICERS MINI. None of these materials may be used except as provided in these Terms of Use.

3. To the User that choose to subscribe to ARTIFICERS MINI exclusive content. The subscription will authorize members to access videos, texts, images and files for 3D printing, in STL format for personal purposes. However, in addition to the prohibitions presented in item 1 of these Terms of Use, they may not distribute, assign, use for public or commercial purposes in any way the printed content, whether free or onerous.

4. New content will be provided on the first day of each month. The old content will only be available to members who have purchased such products, or when ARTIFICERS MINI grants access. ARTIFICERS MINI may charge for individual files or packs for older content. Under no circumstances will ARTIFICERS MINI provide the User any printed contents.

5. Subscriptions to become a member will be charged a monthly or annual fee by ARTIFICERS MINI, according to prices published on its website, with the initial payment being on the day of hiring the service and on the first day of each month. Payment will be made exclusively through Stripe platform (www.stripe.com), through online debit or credit card, and the User is responsible for opening one's own account. The prices and subscription plans may be changed at the sole discretion of ARTIFICERS MINI, but with prior notice to the User's registered email.

6. The User must always keep one's information up to date, such as name, address, data for the subscription payment and e-mail. Personal information is subject to the Privacy Policy.

7. The User who purchases any subscription agrees with the price and conditions of the chosen plan, as well as that the payment will be made through Stripe, whose platform fees will be borne by the User. The subscription will be automatically extended for successive periods, with pre-established rates charged for the respective months, or year, if the User has chosen the annual plan. Cancellation can be requested at any time, but 48 hours in advance of the last day of the month, to avoid a new charge.

8. If the User who cancels the plan has not downloaded the file in the respective month, one will not be charged for that month. However, if one downloads the content provided in the month of cancellation, it will be charged.

9. At the sole discretion of ARTIFICERS MINI, the User may be granted a free trial period to access limited content that will be available until the end of the free period. Afterwards, the User may or may not become a member of the website. The User who is in the free trial period must respect the rules of these Terms of Use.

10. Under no circumstances will the User be able to provide their credentials (login and password) to third parties, under penalty of violation by the company's policy and account cancellation.

11. Some information and news on the ARTIFICERS MINI website may not be accurate, and there is no liability for it. However, ARTIFICERS MINI is committed to keep all available content updated as much as possible.

12. By registering on the ARTIFICERS MINI website, the User agrees to receive notifications, announcements, reports, documents, extracts, communications about new products or services about ARTIFICERS MINI, which will be sent to the email registered by the User.

13. If the User sends comments or suggestions about the website to ARTIFICERS MINI, such as notes, texts, drawings, images, videos, among others, the rights to the content will belong exclusively to ARTIFICERS MINI, without implying any burden or indemnification and it may even be used for any purpose, whether costly or not.

14. ARTIFICERS MINI will endeavor to restrict unauthorized third party to access to our data and files. However, no system, protected by password or not, can be completely impenetrable. Therefore, the User acknowledges that an unauthorized third party may access, view, copy, modify or distribute data and files contained in the website, unduly.

15. ARTIFICERS MINI is prohibited from disclosing any personally identifiable information about the User to third parties, except when necessary to obey the law, request from the Judiciary and public bodies, or enforce these Terms of Use.

16. ARTIFICERS MINI will not be responsible for any performance or service issues caused by any third parties website or third parties service provider, including the web service provider, Stripe, browser, etc.

17. ARTIFICERS MINI reserves the right to limit the User's access to the website and its contents in case of violation of the rules of these Terms of Use or other ARTIFICERS MINI conditions, of the specific legislation or in case of default. Suspension, cancellation or blocking the account will restrict the User from accessing all content available to members, including content from previous months.

18. The User must indemnify ARTIFICERS MINI, its representatives, employees and suppliers, from any and all liabilities, claims, damages and expenses, including attorneys' fees, arising from or related to the violation of these Terms of Use, the law, conventions and treaties, in which Brazil is signatory, any content on the website that the User may post or share, without the proper authorizations and that cause damage to third parties, even for personal or property rights.

19. Furthermore, the User agrees to exempt ARTIFICERS MINI, its representatives, employees and suppliers for damages that it may cause by violating the rules of these Terms of Use.

20. This contract will be governed and interpreted in accordance with the laws of Brazil, conventions and treaties to which it is a signatory, and rules of the State of Santa Catarina, without giving effect to any principles of conflict of laws. The User is subject to the jurisdiction of the state and federal courts of Itapema, State of Santa Catarina, Brazil, which is competent to resolve any doubts that may arise in the execution of these Terms of Use and the website.

21. Any provision of these Terms of Use considered illegal, void or for any reason unenforceable, will not invalidate this document in its entirety, the other provisions remaining valid.

22. These Terms of Use may be revised at any time, updating this posting. The User will be linked to revisions and changes to these Terms of Use, regardless of prior notice. Thus, the User must read these Terms of Use regularly.
